Inter-Tribal Court of Appeals of Nevada
The Inter-Tribal Court of Appeals of Nevada (“ITCAN” or “Court”) is a federally funded appellate court administered by the Inter-Tribal Council of Nevada, Inc. (“ITCN”), and is governed by a board of directors consisting of representatives of Nevada Indian Tribes. ITCN is a Nevada non-profit corporation that provides community-oriented programs.
The Court provides appellate review of civil and criminal trial court decisions from participating tribes in Nevada. A Court Administrator maintains the ITCAN’s operations. Appeals are reviewed and decided by Appellate Court justices who are also licensed attorneys with substantial experience in Indian law and tribal government. The Justices also assist with the administration, organization, and management of the appeals. The Court follows the ITCAN Rules of Procedure, which governs the operations of the Court.
When the appeal is fully organized, briefed, and ready for oral argument, the Court may schedule a virtual, public hearing where the parties or their representatives present their arguments and answer questions from the Justices. Each party or representative is given at least thirty minutes to
present their legal arguments. Following oral argument, the Court will either enter an order requiring additional briefing or it will enter a written decision on the merits. Court decisions are provided to the parties and their representatives, as well as to the lower court from which the appeal was taken. Decisions are generally based on precedent from this Court, tribal laws, federal laws and regulations, and state law under appropriate circumstances. Appellate case records, including Court decisions, are kept in a paper file, as well as on an electronic database. The Court serves individuals, tribal governments, businesses, and the public. The Court is overseen by the Western Nevada Agency of the Bureau of Indian Affairs.
